Monday, Oct. 20th -- NEW!  FMLA.  FELTG Guest Speaker Carl Bosland. The latest addition to the FELTG catalogue.  Legal and human resource professionals agree: the Family and Medical Leave Act is one of the most difficult laws to correctly administer.  In fact, in most cases, federal employers must comply with the requirements of two FMLA laws. 

FMLA compliance is further complicated by the interaction of the law with federal and agency leave policies, collective bargaining agreements, workers’ compensation, HIPPA, and the ADA.  Legislative, regulatory, and case law developments over the past 15 years have greatly impacted how the law is interpreted and applied. This one-day workshop will provide you with detailed information and in-depth understanding to ensure compliance with the FMLA based on the latest federal court and MSPB decisions and legislative developments.  In addition to best practices, you’ll get practical advice on the most difficult FMLA issues you face every day.

Tuesday, Oct. 21st -- NEW! The Judges View.  Former AJs Gary Gilbert and Eleanor Laws moderate a discussion with current AJs (TBA) from the EEOC and/or the MSPB  on what the judges view as best practices (and worst pitfalls) in the areas of motions practice, discovery, the hearing and emerging trends in EEOC and MSPB law and practice.

Wednesday, Oct. 22nd --NEW! Whistleblowing and Other Retaliation Claims. Wiley, Broida and Laws. The Title VII session will provide an in-depth review of reprisal for EEO activity. We will cover the types of things that constitute protected activity, with respect to both participation in the EEO process and voicing opposition to discrimination in the workplace. The circumstances under which someone else's EEO activity may be the basis of a reprisal claim, whether a viable EEO reprisal claim can arise from an MSPB appeal, union grievance, workers' compensation claim, etc. will be discussed, with examples from the EEOC's case law. The session will also cover the Supreme Court's decision in Burlington Northern, and the Commission's interpretation of that case, regarding what constitutes a sufficient adverse action for a reprisal case. Finally, we will cover the essential elements of a reprisal claim, with a focus on the causal connection between the protected activity and the adverse action.

Thursday, Oct. 23rd -- Labor Relations, Part I.  Peter Broida and William Wiley.  Overview of statures and definitions, basic rights and procedures; negotiability of union proposals, Weingarten rights, formal discussions, commonly bargained-for rights.

Friday, Oct. 24th -- Labor Relations, Part II.  Broida and Wiley. Information requests, official time use and abuse, unfair labor practices, investigations and remedies; grievances, appeals, interface with EEOC and MSPB; arbitration overview.

Each day begins at 8:30 and ends at 4:00 with an hour for lunch. Continental breakfast is served beginning at 8:00.
