Current Position
Mr. Wiley is an attorney in private practice concentrating in the area of federal employment and discrimination law. He serves as a Director of the Federal Employment Law Training group, and as Dean of the California Federal School of Law in Washington, D.C. and San Diego, California.
Chief Counsel, U.S. Merit Systems Protection Board
As a Presidential appointee, reviewed 1500 to 2000 case files annually on behalf of three Board Members over nine years. Established facts, applied law and precedent, and recommended proposed findings for each substantive appeal. Applied an expertise in the areas of adverse actions, unacceptable performance removals, discrimination, harassment, whistleblower reprisal, veterans’ rights, federal retirement, workers’ compensation, and other areas of appellate jurisdiction. On occasion, served as an MSPB administrative judge. Served three terms, totaling ten years.
Chief of Staff to the General Counsel, Federal Labor Relations Authority
As a Presidential appointee, reviewed 1000 to 1200 unfair labor practice charge case files annually over a three-year period. Established facts, applied law, and recommended proposed dispositions. Applied an expertise in the areas of protected activity reprisal, obligation to bargain, negotiability, management rights, bargain tactics, investigation techniques, Weingarten rights, and other areas of federal labor law.
Regional Employee Relations Officer, Department of the Navy
Over a 12-year career, began as a personnel management intern and ended as the regional policy advisor for 25,000 employees located in 20 geographically dispersed organizations. Advised local-level managers and employee relations practitioners on all aspects of the field, including disciplinary actions, appeals, investigations, grievances, union-management relations and obligations, mediation, discrimination, and reprisal. Represented the agency before the Merit Systems Protection Board, the Federal Labor Relations Authority, the Office of Special Counsel, the Equal Employment Opportunity Commission, the Office of Workers’ Compensation, the Federal Mediation and Conciliation Service, and in arbitration under various collective bargaining agreements. On occasion, served as a grievance examiner.

            

For a three year period, presented seminars, wrote newsletters, and provided technical assistance to agencies in the areas of federal employment law. Bargained with local union officials, prepared disciplinary actions, represented before the Merit Systems Protection Board, investigated and resolved grievances and discrimination complaints, and evaluated case files to determine the merits of charges and likelihood of success of proposed actions. Authored books on the topics of sexual harassment, unacceptable performance, civil liability of federal employees, and the regulatory and statutory framework of federal employment law.
