Katherine
R. Atkinson is an associate attorney with the Law Offices of Gary M.
Gilbert, P.C., where she represents both plaintiffs and employers.
Ms. Atkinson played an instrumental role in a ground-breaking 2006
Department of Agriculture victory in a sexual harassment case. Ms.
Atkinson’s argument that the Agency was entitled to the “Farragher
and Ellerth” affirmative defense was successful
on summary judgment before the Administrative Judge and on appeal to the
Commission (EEOC Appeal No. 01A60388).
That defense approved by the U.S. Supreme Court allows an employer to
avoid liability for sexually hostile work environment claims where (a)
the employer exercised reasonable care to prevent and correct promptly
any sexually harassing behavior,
and (b) the employee unreasonably failed to take advantage of any
protective or corrective opportunities
provided by the employer or to avoid harm otherwise. Ms. Atkinson also
assists with writing several of Mr. Gilbert’s books, including a
forthcoming book on Hostile Work Environment law, as well as the Disability
Discrimination Law Deskbook and Compensatory Damages and Other
Remedies in Federal Sector Employment Discrimination Cases.
She is a member of the
Maryland
bar, and recently co-authored a forthcoming article analyzing the
various county employment discrimination statutes in
Maryland
for Trial Reporter, the publication of the Maryland Trial Lawyers
Association.
Prior to working for Mr. Gilbert, Ms.
Atkinson interned for Judge Gerald Bruce Lee in the United States
District Court for the Eastern District of Virginia, where she worked on
the interesting employment discrimination case Gaskins v. BFI Waste
Services.
Ms. Atkinson received her J.D. from
American
University
’s Washington College of Law. She was a senior staff member and
note and comment mentor for the Journal of Gender, Social Policy, and
the Law, and a staff writer and articles editor for the Human
Rights Brief. Ms. Atkinson also worked as a teaching assistant
for two years in the Legal Rhetoric: Writing and Research Program.

Robert L'Heureux is an attorney in the private practice of employment
and white-collar criminal law in Alexandria, Virginia. He was, for some
14 years, the Associate Special Counsel for Investigation at the U.S.
Office of Special Counsel, supervising the collection of evidence in
thousands of whistleblower reprisal cases. He was counsel during early
successful OSC litigation on behalf of whistleblowers. Since leaving
government, he has successfully represented both individuals and
government agencies in whistleblower reprisal cases. His other
government experience included service as a Marine Corps officer, a
Special Agent of the Naval Investigative Service, and Assistant to the
Inspector General of the SBA. He represents individuals and government
agencies before the MSPB and EEOC, and individuals in all courts in
Virginia and the District of Columbia. He also lectures and consults on
questions of federal employment law, trial and hearing advocacy, and

Carl C. Bosland is one of Americas foremost
authorities on the federal Family and Medical Leave Act. As
creator and editor of a national newsletter devoted to the FMLA,
as the author of several FMLA guides and caselaw monographs, and
as a prolific trainer on the requirements of the Act, Carl has
closely followed developments in the FMLA since its enactment in
1993.
Carl is an attorney and arbitrator with more
than 17 years of labor and employment law experience in the
federal and private sectors. He received his law degree from the
Fordham University School of Law in 1986. In 1990, Carl received
a Masters of Law in Labor Law from the New York University
School of Law, where he was awarded the Seymour Goldstein
Memorial Prize for Academic Excellence in Labor Relations. After
11 years of federal service, Carl left the United States Postal
Service to return to private practice. During his Postal tenure
he held the position of Deputy Managing Counsel for the Western
Area, where he served as principal labor and employment law
counsel to senior management in a 22 state area with 118,000
employees in 8300 facilities. Carl also served as lead counsel
and manager of a national EEO class action team, as Acting
Managing Counsel of the Western Area and of the Philadelphia Law
Offices, and as Manager of the national MSPB Task Force, which
defended the agency against thousands of appeals and EEO
complaints arising out of the reorganization of the Postal
Service.
